Srinagar, Feb 2 : Observing that deterrent action would have to be taken against all those, who were involved in illegal constructions in and around Dal lake, a High Court division bench today sought suggestions from amicus curie in this regard. Hearing a PIL, the bench of Justice M H Attar and Justice A M Magrey also initiated contempt proceedings against chairman and secretary of J&K Pollution Control Board (PCB) and asked them to show cause as to why they should not be punished for their failure to file report after every two weeks. "Deterrent action would have to be taken against the officials and all those persons involved in raising illegal constructions which would include the owner of the structure as well," the bench said and asked the amicus curie to come up with concrete suggestions for dealing with such a situation. Meanwhile, the court observed that the issue regarding test of discharge from STPs was of considerable pubic importance and initiate contempt proceedings against the PCB's chairman and secretary. "It prima facie appears that PCB has deliberately and intentionally violated the court directions and shown a complete non-compliance. The court is left with no option but to initiate contempt proceedings against PCB chairman Abdul Ruzak and secretary Vasa Yadav. Registry is directed to frame rule against them," the bench directed. "Both will appear in person before the court on the next date to show cause as to why they shall not be punished for committing contempt of the court," the division said. The court also directed the chief secretary to consider shifting of 'such officers' from PCB "who do not discharge charge their duties and also prima facie violate court orders". Meanwhile, the IGP, Kashmir, filed a separate report regarding the installation of four CCTV cameras around Dal Lake to prevent enter of construction material as well as to keep a check on illegal constructions. |
