37 years later, 5 years jail in sodomy case | | | Early Times Report
Srinagar, Feb 8: A Srinagar court today sentenced a man to five years in jail after holding him guilty for sodomy incident which had taken place in 1978. The Additional Session Judge S R Gandhi, also imposed a fine of Rs 50000 on the convict, Nazir Ahmad Ganie who is a resident of Srinagar's Karfali Mohalla. According to prosecution, Nazir had befriended the boy, who was 14 years of age and on the day of occurrence had compelled him to drink liquor. He then took the boy at an isolated place where he had made preparations to photograph the incident, the prosecution said. "He made all the attempts to commit sodomy upon the helpless boy and get it photographed with a motive to blackmail him or to get his mouth shut up," the prosecution argued while seeking stern punishment to the convict. On the other hand, the counsel for the convict submitted that the offence has been committed some 37 years ago After hearing both the sides, the court sentenced the convict to undergo five years rigorous imprisonment and fined him Rs 50000 offence under section 377 read with 511 of RPC. The court also awarded six months rigorous imprisonment and fine of Rs 1000 under section 120-B (criminal conspiracy). "Both the sentences shall run concurrently," the court added. |
