HC directs Jammu South SDM to submit inquiry report or appear in person on February 23 | PIL for probe into 724 kanals of land owned by SRK Associates at Sunjwan | | Early Times Report
Jammu, Feb 8: In a PIL, highlighting the alleged hushing up of Chatha- Sunjwan land scam, a high court division bench of Chief Justice N Paul Vasantha Kumar and Justice Bansi Lal Bhat today directed SDM, Jammu South to submit his inquiry report by or before February 23, 2016, with regard to the probe ordered by revenue department vide government order No 151-Rev (S) of October 7, 2015 concerning alienation of land measuring 724 kanals at Sunjwan to SRK Associates allegedly in contravention of the ceiling limit prescribed under J&K Agrarian Reforms Act, 1976, Big Landed Estates Abolition Act and other land laws governing the field or in default he will appear in person. The petitioner's counsel drew the attention of the bench to the order of November 3, 2015 when the AAG appearing for revenue department had sought four weeks time to submit the inquiry report being conducted by SDM, Jammu South. He submitted that in the October 7, 2015 government order, the revenue department had stipulated 15 days time for completion of probe but till date more than four months had elapsed but the inquiry officer had not finalized the inquiry. He said despite repeated opportunities, the housing and urban development department had not filed its response to the Miscellaneous Petition No 4/2015 seeking action against all those officers of JDA who had failed to take action against SRK Associates on the directions of the Administrative Department issued vide No U&D/15/2008/JDA/AS-32 dated February 5, 2008 whereby then JDA VC had been directed to put on hold the building permission granted in favour of SRK Associates. The department was shielding the JDA officers who had failed to take action against the colonizer, he added. SRK Associates' counsel sought the dismissal of the PIL as he argued that it had been filed with ulterior motives and it had already achieved its purpose but the petitioner was filing application after application to expand the scope of the PIL. He submitted that the main PIL along with other connected matters may be heard today only and he would satisfy the bench that there was nothing in this PIL. The bench, after considering the submissions of two sides, directed the SDM, Jammu South, to file the inquiry report by or before February 23, 2016, failing which he was directed to appear in person.
