HC seeks compliance on cutting down of Russian poplars | | | Early Times Report
srinagar, May 15: The state high court has directed all deputy commissioners of Kashmir to file compliance report by May 20 regarding cutting down of Russian poplar trees across the valley. "Enormous plantation and growth of poplar trees of Russian species are allegedly proving catastrophic and a big health hazard. Can such a nuisance be allowed to exist totally to the discomfort of human beings? Answer has to be no. The trees which are proving dangerous and threat to the healthy life can be categorized as being public nuisance," Justice Mohammad Yaqoob Mir observed while hearing a petition, seeking directions regarding cutting down of Russian poplars near his residence at Zakura on outskirts of Srinagar. "Almost all the elderly people and children are allegedly coughing. People are voicing concern as against the violent and allergic affects of poplar seeds as the cottony pollen has created panic and made the life of human beings, more particularly of the elders and the children, uncomfortable," the court said, adding that all DCs of the valley, at the first instance, are required to file the compliance report by or before May 20. Last year, hearing the same petition, the high court had directed that all the tehsils shall be personally responsible for ensuring the compliance of the orders which would be passed by all the DCs of the valley. "It is of common knowledge that the pollen of Poplar (Russian Species) is adversely affecting the health of general public, mostly of the elderly people and the children," the court had said, adding, "Right to life is a basic human right which is recognized by Article 21 of the Constitution of India. The life can become meaningful only when a person is healthy. To live a healthy life is one of the essential components of Article 21 of the Constitution of India."
