Court summons girl in 'false' rape case | | | Early Times Report Jammu, Aug 11: Following a complaint filed by a youth, who alleged that he was falsely implicated in a rape case, the court has summoned the girl along with the copy of the complaint. As per the complaint, the duo had friendly relations and the complainant used to visit the girl's house frequently. He said he also used to help her financially. He alleged that when he demanded the borrowed money from her, she lodged a false FIR against him at Bakshi Nagar police station for the commission of offences under section 376 and 452 of RPC on August 28, 2015. The challan of the case was presented in the court of 3rd additional sessions judge, Jammu. During trial, the girl resiled from her statement recorded under section 164 A of CrPC and stated that no rape was committed on her and on the basis of her statement, the court acquitted the youth of the charges leveled against him under sections 376 and 452 of RPC. In his complaint, the youth has pleaded that due to the false allegations leveled against him by the girl, he had lost his reputation in public. Even his mother had to face embarrassing situation, he alleged, saying that he had also suffered a huge loss of money and career. The court stated that keeping in view the overall aspect of the matter, the record available on the file prima-facie discloses commission of offence under section 500 (b) of RPC against the accused while there was no specific allegation against the mother and the brother of the girl, so there was no sufficient ground for proceeding against them for commission of offence under section 500 (b) of RPC. As such, the complaint to that extent was dismissed as this stage. The court also directed to issue summons to the accused girl for her appearance along with a copy of the complaint on August 12, 2016 for further proceedings. |
