PIL on cancellation of mining lease from Ravi river | HC grants state 3 weeks to file response | | Early Times Report Jammu, Oct 6 : In a PIL filed for cancellation of mining lease from Ravi river, a high court division bench of Chief Justice N Paul Vasanthakumar and Justice Tashi Rabstan today granted three weeks to state for filing its response. In the PIL, the petitioner has sought direction to respondents for cancelling the mining lease permit for Ravi issued under J&K Minor Mineral Concession Rules, 1962. A direction was also sought to restrain the government from issuing any mining lease or quarrying permit for Ravi till the river and its attending environment were restored to sustainable levels or appoint a committee of experts under the direct supervision of this court to study and submit a comprehensive report about the effects and scope of mining in the river. The petitioner also sought direction to respondents to cancel the consent orders issued to stone crushers operating in Ravi under sections 25 and 26 of the Water (Prevention and Control of Pollution) Act, 1974 and under Section 21 of the Air (Prevention and Control of Pollution) Act, 1981 and for framing and notifying new Minor Mineral Rules within a reasonable time period which are required to be put into force under the 'ratio' of the Supreme Court judgment in Deepak Kumar v/s State of Haryana. He also prayed the court to direct the state vigilance organisation to conduct a thorough investigation and file periodic status reports before this court into the abuse of official position in the grant and renewal of mining lease or quarrying permits for river Ravi. |
