Registrar Coop Societies order on appointment of CCBL administrator quashed | | | Early Times Report Jammu, Oct 25: High court judge Alok Aradhe has ordered the quashment of September 17, 2015 order of Registrar Cooperative Societies, whereby he had appointed the joint registrar as administrator of Citizens Cooperative Bank Ltd (CCBL) in exercise of powers under section 29(4) of the Act. The court directive came in a petition filed by the CCBL's Board of Directors. Justice Aradhe, after hearing the two sides, observed that from perusal of section 29(3) of the Act, it was evident that the committee of the society, before the expiry of 90 days of its term, had to make arrangements for the constitution of the new committee in accordance with the provisions of the Act, rules and bye-laws. In the instant case, well before the expiry of 90 days, the process of election was initiated by the committee of the society which was evident from the facts stated supra. However, instead of holding elections, the registrar by the impugned order before expiry of the tenure of the committee of the society had appointed an Administrator. The impugned order was therefore in stark contravention of section 29 of the Act, the court said, observing that it could not sustain in the eye of law. "The impugned is quashed. The registrar is directed to hold elections of the society within two months," Justice Aradhe said. |
