HC grants parties three weeks time on checklist of individuals, mining places

Srinagar, Mar 20: High Court today adjourned by three weeks to enable parties to prepare a checklist or safety measures for the operation of mines in respect of individuals and mining places in the state.
As the hearing of a Public Interest Litigation started, Assistant Solicitor General of India Shamsi, who had to file fresh status report in all aspects of the matter including a check list or safety measures for the operation of mines in respect of individuals and mining place, submitted that the report has been filed, wherein rules are in place providing for all safety measures and other allied matters. A division bench of the court ordered that copy of the status report be supplied to senior advocate Mr. Qadiri, as also to other learned counsel appearing for the parties.
"Respondent Nos. 1 and 2 were also to provide a check list of safety measures which they have not. In addition thereto, the Joint Director, Geology and Mining Department, J&K Government was to hold a meeting with Qadiri. Mr Shamsi, learned ASGI was to ensure that participation of a senior officer of the concerned department of Mines and they had to finalize the check list," the court said.
According to Qadiri, he has received a check list from the Government and the petitioner has also prepared a check list, however, final decision could not be taken in the meeting, therefore, some time is required.
"Matter is adjourned for three weeks so as to enable Qadiri and others to finalize the process of formulation of check list and to file the same on the next date," the court said and posted April 19.
The Court had also observed that due to mining which goes beyond limits claims various precious lives as such safety gadgets and medical facility should also be in place on mining sites.
