Court awards 2 years imprisonment to accused

Srinagar, July 2: Sub-Judge/Forest Magistr-ate Srinagar M R Chak today awarded two years imprisonment to Mohsin Shah son of Wahid Shah resident of Brane, Nishat near water works Srinagar who cheated a foreigner tourist and made money in the name of marriage.
According to the police case, a written complaint was lodged by the complainant namely Sarawit Patara Chokchai of Thailand staying in Germany A/P Shining Star Guest House, Dalgate Srinagar alleging there in; that she came to Kashmir in the year 2007 and stayed in the House Boat of Aslam Dangola known as "Rubany House Boat" situated at Nehru Park; that said Aslam Dangola introduced her to one Mohsin, who became friendly with her.
When she again came to Kashmir, she stayed with Mohsin, who asked her for money to buy a car and construct a house before they got married. After she gave him 6.5 lakhs for the house and 3 lakhs for car, Mohsin started to avoid her. She alleged that the accused had sexual intercourse with her assuring to get married, but continued to seek, more money for starting his travel agency.
While the petitioner gave her 15 lakhs on different pretexts on the assurance of getting married to her, she was actually cheated by the accused in connivance with his mother and sister.
Upon this receipt of complaint, Police registered a case and after completion of the investigation challan was presented. Sub-Judge/Forest Magistrate Srinagar M R Chak after hearing Prosecuting Officer Shahista Zahoor whereas Adv Ishtiaq Khan for the accused persons, observed that prosecution has proved its case as against accused Mohsin Shah u/sec 420 RPC by leading cogent evidence who is accordingly convicted and sentenced to undergo imprisonment for a period of two years and acquitted sister and mother of the convict of the charges u/sec 420/109 RPC for want of evidence.
