SHRC seeks presence of IGP Jammu in land grabbing case | | | Early Times Report
Jammu, Oct 29: Justice (retired) Bilal Nazki, chairperson J&K State Human Rights Commission (SHRC), has sought the presence of Inspector General of Police (IGP) Jammu on October 30 to explain about a report submitted by the Staff Officer pertaining to a complaint of alleged land grabbing. "In the light of order dated 6-03-2018, the Staff Officer to IGP Jammu has filed a report. The report needs to be explained by the IGP Jammu. IGP Jammu shall remain present to explain the report on 30-10-2018. A reminder be also sent to the Chief Secretary J&K for his report in the light of order dated 6-03-2018", reads the order issued by Justice Nazki. The Deputy Commissioner Jammu in his report submitted to the SHRC concluded that to draw the corollary from the observations and facts inked above, it is submitted that "yes, it is a fact that complainants namely Rashu Kanna, Kanwal Nain Kak are worst sufferers who have fought a long protracted battle for their justice but of no avail." "To dig out the facts from the available records, the enquiry team has sincerely made an endeavour to bring out the facts. During the course of enquiry, it was observed that the complainants have purchased plots measuring 1 kanal 05 marlas falling in Khasra No. 355, situated at village Thather, Tehsil Jammu, now Jammu North, through the registered sale deeds. But the possession was given to the vendees by the vendors in Khasra no. 373, not in Khasra no. 355 as made out by Demarcation Commission headed by then Settlement Commission J&K", reads the report. The place where the vendees had taken possession was considered/treated in Khasra no. 355 by the Revenue officials as well as vendors as stated by the then Revenue officials. Since there was no visible line between the two Khasra numbers, i.e., 355 & 373, it was only later during the demarcation conducted under the supervision of the then Settlement Commissioner of J&K, the bifurcation line delineating the above said 2 survey nos. was drawn on the basis of the coordinates/dimensions of field book 1979.80 BK," the report said. "The Fard Intekhabs issued by the Revenue officials during 1990s should have been drawn on the Tatima Shajra, not on Dasti Khaka. Moreover the Revenue officials should have been circumspect while issuing the Fards during 2005-06 when the land in question was re-sold", reads the report. The report further stated that the Latha being unauthenticated alleged by the complainants, as found authentic. All superior subordinate officers tried their best to bring out the facts and solution thereof. The private persons allegedly land mafia have been found involved in unscrupulous sale and purchase of land as ascertained by enquiry reports of senior officers and after enquiring from the local inhabitants. It was again mentioned in the report that the complainants are worse sufferers as they are not able to acquire the possession of land which they have purchased. Factually, the issue of vendee (complainants) land is a matter of possession of land which is the subject matter of civil court and for which all the earlier enquiry officers have also suggested that the complainants should take up the matter in the civil court to get the possession of their land. "We too recommend the similar course," adds the order submitted by the Deputy Commissioner Jammu to the SHRC. |
