Allotment of Fair Price shops in Budgam

Budgam, Mar 4: State Information Commission (SIC) in its order has said that grievance redressal other than Right to Information Act (RTI) is not the mandate of Commission as there are appropriate forums for the same. SIC issued this order while disposing off an RTI appeal filed against Assistant Director Food Civil Supplies & Consumer Affairs (FCS & CA) Budgam.
Details available with Early Times reveal that one Asif Ali Dar a resident of Zoorigund Budgam filed an application under J&K RTI Act 2009 before the Public Information Officer (PIO) Directorate of Food, Civil Supplies and Consumer Affairs (FCS&CA) Depart-ment, Kashmir on 8.8.2018 for providing a copy of enquiry report conducted by Assistant Director (Stores) FCS&CA Depart-ment, Kashmir regarding issuance of Fair Price Shop licenses in District Budgam.
In response to the said RTI request, the PIO/Joint Director (Administration ) furnished the information sought for by the appellant but Asif Ali Dar filed First Appeal on 19.10.2018 seeking reasons for issuance of Fair Price Shop licence in favour of one Mohammad Shafi wani.
Pursuant to the direction of the FAA/ Director FCS & CA Kashmir , the Assistant Director, FCS&CA, Budgam vide her communication dated 30.102.018 informed the appellant that the Administrative Departm-ent vide letter dated 25.09.2017 conveyed the approval for establishment to new Fair Price Shop in favour of Mohammad Shafi Wani. The appellant was also informed that the information sought by the appellant has already been furnished to him.
Not satisfied with the reply of the PIO/Assistant Director, FCS&CA, Budgam the appellant filed 2nd Appeal before the State Information Commission (SIC) on 12.11.2018. While disposing off the appeal SIC in its order said, "since the information sought by the appellant through his basic RTI application has been furnished to him, nothing further survives for adjudication in this appeal and accordingly the appeal is disposed of without any order or direction. In case, however, the appellant has some grievances he can approach appropriate authority for redressal. He can use the said information for projecting his grievance before the appropriate authority "
