HC asks govt to clarify its stand on cancellation of KVIB selections | | | Srinagar, July 30: The State High Court has asked government to file an affidavit, clarifying stand regarding cancellation of all selection list of the Khadi Village & Industries Board (KVIB) via an order on June 28. Hearing an appeal filed by the some aggrieved candidates, the division bench of the court issued notice to the government, asking it to show cause as to why the appeal be not admitted. Senior Additional Advocate General B A Dar, accepted the notice and submitted that he may be permitted to file affidavit clarifying the stand of the government with regard the cancellation of the selection. The court asked the senior AAG to file the affidavit before next date of hearing posted on August 9. The court's directions followed submissions by senior advocate Z A Shah that the order dated 28th June, 2019 tantamount to cancellation of the selection of the appellants in gross violation of applicable rules and principles of natural justice. He submitted that in view of the cancellation, the appointment of the appellants tantamount to have been cancelled. He submited that the observation of the Single Judge while dismissing the petition in limine by order dated 16.7.2019 that the writ petition is premature for the reason that the petitioners shall have to wait for the outcome of the decision of the Board is erroneous. "The decision already stands taken as is conveyed by the direction contained in serial no. (i) of the impugned order," he added. The Governor administration had cancelled selection list by issuing a government order (No. 127-IND of 2019), announcing that all the selections made in the KVIB pursuant to advertisement notice No. KVIB/01 of 2016 dated 8 October 2016 are quashed/cancelled. "The KVIB will provide opportunity of being heard to all the candidates appointed to different category of posts pursuant to the advertisement notice dated 08.10.2016 and fulfill all other formalities required under law before cancelling the appointments of these candidates," the order reads further. Based on recommendations of a three-member inquiry panel headed by then Principal Secretary Home, R.K. Goyal, the Industries & Commerce department ordered cancellation of the selections made in the KVIB during the PDP-BJP rule. The selection process had come under sharp criticism from different quarters after kith and kin of several political functionaries and influential ones figured in the list. |
