DB directs Div Com Kmr to file report on garbage removal from Badamibagh

JAMMU, Oct 1: A Division Bench of the State High Court comprising Chief Justice Gita Mittal and Justice Rashid Ali while hearing Public Interest Litigation regarding preservation of Sonamarg, observed that Divisional Commissioner, Kashmir has also not placed on record the report regarding the removal of garbage from the Badambibagh; its dumping and utilization as also the availability of dumping site, as was directed on the last date of hearing and directed Divisional Commissioner Kashmir to file this report in this regard.
DB further observed that the status report dated 2nd August, 2019 (page 195) has been filed by the Principal Secretary, Housing and Urban Development Department of the State Government, informing this Court that the Model Solid Waste Bye Laws stand published by the Government order dated 31st July, 2019 for adaption and notification by the Municipal Corporations, Councils and Committees of the State.
DB further observed that a direction is issued to the Sonamarg Development Authority to inform this court with regard to notification of the Model Solid Waste Bye Laws. The Sonamarg Development Authority shall also inform this court about the steps taken to implement the Solid Waste Management Bye Laws and other measures which have been taken regarding the Solid Waste Management Bye Laws.
DB further observed that on 24th May, 2019, this court was informed by Fayaz Ahmad Khan, Chief Town Planner, that the process of finalizing the Request For Proposal (RFP) and for revision of the Master Plan is expected to be completed within one year.
Nothing has been placed before us as to what is the status of the preparation of Master Plan Sonamarg-2040 or the re-delineation of the local area of the Sonamarg Master Plan limits, DB observed.
It is submitted by Chashoo, AAG, that he was unable to contact Mushtaq Ahmad Rather, Chief Executive Officer of the Sonamarg Development Authority and he does not have instructions.
Upon this DB directed the report on all the issues noted by us in the order dated 24th May, 2019 and hereinabove shall be positively filed within three weeks from today. —JNF
