Kishtwar, June 2: A Jammu and Kashmir High Court bench headed by Justice Sanjeev Kumar direct Commissioner Secretary Urban Local Bodies, director Urban Local Bodies, Deputy Commissioner Kishtwar and Executive Officer Municipal Council Kishtwar to ensure that the candidate who do not owe any disqualification in terms of section 16 of Jammu and Kashmir Municipal Act 2000 alone shall be elected as President Municipal Council Kishtwar. As per the details available with Early Times, in WP(C) bearing No.557/2021 titled Shahid Parvez Kripak V/S UT of J&K and others was filed before the High Court by N D Qazi advocate seeking quashing of the nomination of Sajad Ahmad Najar and direction to the official respondents not to allow the private respondent to participate in the process of election of President, Municipal Council, Kishtwar. The writ petition has been filed by Qazi Advocate against Najar for contesting the election for the post of President of MC, Kishtwar on the ground that the same owes disqualification is not eligible under section 16 of the Jammu and Kashmir Municipal Act, 2000. Qazi Advocate argued before the court that Najar is involved in series of FIRs and also history sheet has been opened against him and also is not of a good repute is ineligible for contesting the post of President. The High Court inter alia directed the official respondents that a person who owes disqualification under section 16 of Municipal Committee Act, 2000 shall not contest the election for the post of President Municipal Council, Kishtwar. |
