Section 133-H unconstitutional, discriminatory: KB Jandyal
Mahajans, Khatris Sikhs deprived of buying agri land in J&K

Early Times Report

Jammu, June 16: Former IAS officer of Jammu KB Jandyal has termed the section 133-H of J&K Land Revenue Act as unconstitutional and discriminatory to Mahajan, Khatri and Sikh communities. The section debars members of these communities from buying or selling agricultural land in J&K.
While talking to Early Times Jandyal said that several delegations including BJP had met with the Lieutenant Governor in the recent past regarding withdrawal of section 133-H so that these communities might purchase land.
“I was also a part of one of the delegations and informed the LG about the matter and he had assured us that within 10 days the issue will be resolved but nothing has been done till date,” he said.
He said that there are some vested interests in the LG administration, who are creating huddles.
“The law regarding restriction on purchase of agricultural land was enforced during Maharaja Hari Singh’s regime. Accordingly to it only few kanals of land was allowed to be purchased by these communities but with the passage of time such kind of laws have become obsolete but it is very shocking that this law was not amended even after J&K’s transition into a Union Territory, the Section 133-H was imposed which totally restricted these communities to purchase land,” he added.
The concerned Administrative Department has been creating obstacles despite the fact that in the present era everybody has equal rights and there is no need for such laws in the Land Revenue Act which deprives these communities from purchasing land.
He appealed to the LG administration to look into the matter in a broader perspective and urged him to sort out the issue at the earliest.
