10-years after retirement administrative officer IMPARD denied selection grade
Even High Court intervention fails to move ‘emboldened’ higher ups

SRINAGAR, June 27: For the past one decade or so a superannuated administrative officer of Institute of Management, Public Administration and Rural Development (IMPARD) has been running from pillar to post so that the selection grade of pay is given to him which he was entitled to. Wali Mohammad Sheikh was promoted as administrative officer in IMPARD in 2005 vide order number 153 of 2005 dated 11-4-2005. The officer completed his probation following which he was entitled for promotion under order number 548 of 2007 dated 6-2-2007. Sheikh superannuated from service in April 2011 and at the time of superannuation he had completed five years and nine months of service as administrative officer.
In terms of SRO 273 dated 16-8-1986, Sheikh after completing five years of service as administrative officer was entitled to selection grade of pay. No such benefit was given to him and till date even after 10 years of superannuation the same continues to be denied to him. The administrative officer made different representations so that the benefit is given to him, but of no avail.
In the meantime, benefit of higher selection grade was given to one Ghulam Mohammad Rather who figured at number three of the common seniority list of the officers issued vide circular number 531 IMPA of 2006 dated 6-1-2006. Sheikh was constrained to move the court and the court in fact came to his rescue, but it made no difference for the people at helm at IMPARD.
The High Court by virtue of its order passed on 23-3-2017 directed the respondents to “accord representation of the petitioner which is pending before them and to pass final orders thereon within a period of six weeks from the date of order.” The order was served upon the office of Director General, IMPARD with the hope that quick action would be taken, but that was not to be.
Deputy Director, IMPARD on 5-7-2017 informed Sheikh that his case has been recommended for placing the same before the sub-committee of the Institute as and when convened, for approval. Even though around four years have passed since this correspondence the sub-committee has not met and as such no difference whatsoever has been made to the fate of Sheikh.
Given the fact that no headway was been made in the case Sheikh moved written applications to the higher ups of the Institute on 5-1-2018, 11-10-2018 and 27-2-2019 requesting that his grievance may be addressed while bringing the court order to their notice as well.
Advocate Abid Malla of High Court engaged by Sheikh believes that higher ups of IMPARD have committed contempt of court since they were informed and made aware about the orders of the court, but still then took no action.
The advocate has issued a legal notice to the Director General IMPARD and has through the notice called upon the higher authorities to take up the case of Sheikh on priority basis and decide the same within a period of two weeks from the receipt of the notice. The legal notice was issued on June 14, 2021.
