Court rejects bail plea in abtement to suicide case

JAMMU, Jan 29: Principal Sessions Judge Jammu Kishore Kumar today rejected the bail application of one Karan Singh who was booked by the police in abtement suicide case.
The police report reveals that the applicant-accused is involved in case FIR No: 12/2022 for offences u/s 306 IPC, which was registered on 06.01.2022 in Police Station Nagrota. As per allegations, on 31.12.2021 information was received via PCR at Police Post Sidhra that two persons namely Dilawar Singh and Purna Devi had been admitted in GMC Jammu for treatment of burn injuries. On receiving this information police team headed by ASI Bashir Ahmad of PP Sidhra reached GMC Jammu for recording their statements but the doctors opined that the patients were unfit for statement. On 02.01.2022 the lady namely Purna Devi succumbed to her injuries and subsequently an inquest proceedings under section 174 CrPC vide DD No:27 dated 02.01.2022 were launched and on the same day the statement of injured Dilawar Singh was recorded in presence of independent witnesses, who stated that on 31.12.2021 at 9-10, P.M he sprinkled kerosene oil on himself and set himself on fire. His wife Purna Devi was also present at home and she tried to extinguish the fire but she was also caught the fire but his brothers and children came there and extinguished the fire. He is having dispute with regard to land with Karan Singh and he started construction of the house on 06.10.2021 but Karan Singh got stay from the Court and on 20.10.2021 the police provided the copy of the stay. The accused Karan Singh would daily threatened them that he will make their life miserable and he also threatened in front of the police. He is not having house for residence and due to this he tried to commit suicide. On 06.01.2022 the injured person Dilawar Singh succumbed to his injuries and thereafter FIR No: 12/2021 under section 306 IPC was registered in Police Station Nagrota and subsequently vide DPO Jammu order No: CRB/2022/838-40/DPOJ dated 06.01.2022 a SIT under the supervision of SP Rural, Jammu was constituted for investigating this case.
Principal Sessions Judge Jammu Kishore Kumar after hearing PP Kulbushan Sharma appearing for the police observed that that by the act of the accused victim Dillawar Singh and his wife namely Purna Devi have lost their lives and the family of the victim has become orphan. There is no body to look after the children of the victim. The release of the accused at this stage will be opposed to the cause of public justice as there is likelihood of the accused to influence the witnesses, as the challan against the accused is yet to be filed. With these observations, Court dismissed the bail application.
