Rape accused denied bail

Jammu, Aug 17: An alleged rape accused was today denied bail by presiding officer of fast track court, Kishore Kumar.
Accused Ghulam Hussain, son of Ghulam Mohammad of Dedpeth, Kishtwar, was alleged to have raped the girl at his sister's house at Bantalab.
The girl developed friendly relations with a youth who had wrongly introduced himself to her on mobile phone as Sunil Kumar. His cellphone number was given to her by a girl of her locality about two and a half years back, according to police case.
As she fell in love with him, she was one day called by 'Sunil' at Bakshi Nagar to meet him and when she reached there, she found two boys sitting in a tempo. They introduced themselves as Sunil Kumar and Ghulam Hussain. Thereafter, both of them forcibly got her seated in the tempo and took her to an isolated place at Bus Stand. There Sunil told her that his actual name was Fayaz Ahmed, son of Bashir Ahmed Khan of Dedpath. He then caught hold of her and tried to molest her. When she resisted, he assaulted her and told her that he was a married person. Thereafter, he left her in the vehicle along with Ghulam Hussain who took her to his sister's house at Bantalab under threat and committed rape upon her. Later, he dropped her at Bus Stand.
After hearing both the sides, the judge said in crime against women, particularly, incident of rape of a minor, the courts had already sounded that precaution was to be taken while considering the bail pleas of the offenders.
"It has been impressed upon the judicial officers and sessions judges dealing with such cases to take care and caution in exercising discretion to consider the release or otherwise of the accused on bail pending investigation and trial, lest the discretion so exercised affects adversely the societal interests, investigation and fair trial," he added. With these observations, the court rejected the bail application of accused Ghulam Hussain. (JNF)
