Court stays transfer of chowkidar

Jammu, Aug 17: The transfer of a class-IV employee of Forest department, headed by firebrand leader of BJP, has created a controversy as after nearly one year since court stayed his transfer order, he has been placed under suspension on instructions of Minister, besides his belongings have also forcibly been thrown out from the quarter.
According to the documents in possession of Early Times, Jagdish Kumar (52) is working as Chowkidar in Soil Conservation Training School Miran Sahib for the last many years and has been putting up in a quarter in the School. He was transferred by department in 2015 after which he had knocked the door of High Court, which in turn had stayed his transfer.
Surprisingly, on 13th of August, Jagdish Chander was suspended on instructions of Forest Minister, who visited Miran Sahib and Jagdish was forcibly evicted from the quarter and his belongings were thrown out on road.
Jagdish Chander has alleged that he was transferred with malafide intensions as he had refused to obey orders of Principal, who allegedly had been asking, his wife to work as a domestic help in Principal's house. "The Principal started threatening me with transfer to some remote place and finally I had approached All J&K Non-Gazetted Forest Officers Association (JKNGFOA) in the month of January 2015, which in turn took matter with Principal of Training School and also with higher officials" Jagdish Chander said.
In the letter forwarded to JKNGFOA, Jagdish Chander had made same allegations against Principal of School and he had also presented these applications as mark of proof before High Court, when he challenged the transfer order, in the month of September in High Court and secured a stay.
But things turn ugly for Jagdish Chander, when Minister for Forests visited Miran Sahib on 13th of August, and gave instructions to Conservator of Forest to put him under suspension and also allegedly ordered to throw his belongings from the quarter occupied by Jagdish.
"I was present there in the school on 13th of August and even prepared snacks for Minister. Due to injury in my leg, I went to take medicine but when I returned and reported to Principal, who informed me that Minister had issued orders for suspending him", Jagdish said.
He further alleged that everything was pre-planned and he was made scapegoat by these officials.
"The Principal and Conservator portrayed myself as an indiscipline employee and got orders from Minister as per his choice", Jagdish said, adding that in the suspension order, it has been written that he was absent which was a plain lie as he was very much present in the office on August 13.
He further alleged that the department was deducting HRA for the quarter he had occupied.
"The officials especially Principal was inimical to my presence in the Training school and got me suspended", he alleged.
Principal of Soil Conservation School, Manish Bhardwaj said that on 13th of August Jagdish Chander had marked his attendance in the morning and when Minister had visited, he had thrice called him but Jagdish didn't turn up.
"While making a round of the School, when Minister had a look on the quarter of Jagdish Chander, he found roots of a Peeple tree piercing through the wall and he enquired about the occupant and condition of quarter", he said, adding that Minister was informed that several vacation notices have been served to Jagdish but he refused to oblige.
The Principal further said that while leaving the School, the Minister ordered for vacating the quarter immediately and suspension of Jagdish, who didn't turn up before Minister and later Conservator had ordered his suspension.
On being asked about the allegations leveled by Jagdish of victimizing him after refusal to send her wife to work in his house, the Principal said that on the allegations, an enquiry committee, comprising two women officers, was constituted.
"I have the report of enquiry committee, in which Jagdish had admitted that on instructions of All J&K Non-Gazetted Forest Officers Association (JKNGFOA) he had written the letter, in which leveling allegations against him besides he had admitted that he was never victimized by him. He further said that he had mooted to file a defamation suit but due to sudden demise of his son, he has so far been silent.
