| CEO Pulwama's inaction hampers regularization of Contingent employees | | | Early Times Report
Srinagar, Aug 17: In-spite of the order of State Information Commission (SIC), the Chief Education Officer (CEO) Pulwama is yet to reveal details about the regularization of contingent employees of Education Department in Pulwama district. The said information was denied by the CEO after the same was sought under Right to Information Act (RTI) by an information seeker from Tral Pulwama some months back. In July the SIC had directed the CEO to reveal these details under RTI, but sources say that information is yet to be provided to the information seeker. Details available with Early Times reveal that one Shagufta Parveen R/O Dadsara Tral in Pulwama district had filed an application before PIO/CEO Pulwama through speed post on 26.03.2016 seeking details of Contingent Paid employees/workers of District Pulwama who were regularized until ending March 2016. As no information was received within the prescribed period, information seeker filed First Appeal on 28.04.2016 before the Fist Appellate Authority (FAA) ie Joint Director School Education Kashmir. Thereafter, Second appeal was filed before the State Information Commission (SIC) on 06.06.2016. In her 2nd appeal Shagufta Parveen stated that after filing of the First Appeal, a response from FAA directing her to appear for hearing on 13.05.2016 was received by her on 16.05.2016. The appeal has been filed with the request for appropriate action against the respondents for not providing information to her under State RTI Act.
Joint Director School Education Kashmir Saif Ali Chowhan, (FAA) filed reply before State Information Commission (SIC) submitting that the appeal was forwarded to PIO/CEO Pulwama on 03.05.2016 for providing information/counter statement to the information seeker. The information provided by CEO under letter 19.05.2016 was supplied to the information seeker and appeal was disposed off vide letter dated 16.05.2016 . As per order of Joint Director School Education Kashmir (FAA) dated 16.05.2016, appeal has been disposed of with directions to CEO Pulwama to provide pending information, if any,within five days to the information seeker Shagufta Parveen. As per sources the said information is yet to be made public by the office of CEO Pulwama.
SIC's order dated 27.6.2016 reads as:
"It is therefore evident that FAA has decided the case as per provisions of the Act. Shri Saif Ali Chowhan FAA/Jt. Director DSEK, Ab. Hamid Kumar,PIO/CEO Pulwama and Sheikh Rashid Ahmad, representative of the appellant attended the hearing. CEO Pulwama submitted that information in the format as given in the RTI application has been dispatched to the information seeker on 19.05.2016. The representative of the appellant admitted receipt of this information, but submitted that in the Column of Date of Initial Appointment/Appointing Authority, the particulars of appointing authority has not been given. CEO Pulwama submitted that the information sought pertains to Contingent Paid Workers (CPW), who were appointed by the respective Principals/ ZEO's/School Headmasters. He further submitted that these daily rated persons were regularized on the basis of their initial appointment orders/engagement by the respective schools.From the reply given by the CEO, it is evident that these CPW's have been confirmed by the O/o CEO Pulwama vide various orders as referred to in the statement of information provided to the appellant".
SIC order reads as: "In view of the above, the Commission directs CEO Pulwama to provide copies of initial engagement order of CPW's to the appellant within two weeks. Further, CEO Pulwama is directed to explain the delay in responding the RTI application beyond the period prescribed under the Act within two weeks". |
