HC suspends patwari's conviction, grants bail | | | Early Times Report Jammu, Sept 20 : High court judge Tashi Rabstan has ordered the suspension of execution of sentence of a patwari who was convicted by the special judge of anti-corruption court and awarded two years imprisonment in a case of corruption against him. The court directive came in a criminal appeal filed by patwari Harbans Lal. Justice Tashi, after hearing the two sides, observed that in view the gravity of offence, the manner and method, also keeping in view the submission made and the law laid down by the Apex Court and the position of less chances of the hearing of the appeal in near future, exercise of discretion in favour of accused at this stage was warranted so as to advance the object of Article 21 of the Constitution of India. He allowed the application and directed that pending appeal, execution of sentence was suspended. He ordered to release the accused on furnishing bail bond of Rs 50,000 to the satisfaction of Registrar Judicial and personal bond of the like amount to the satisfaction of Superintendent Jail concerned with a condition that he would ensure his presence before the court on each and every date of hearing. |
