HC gives time to Govt for policy decision | | | Srinagar, Feb 18 : The J&K High Court has granted government time till 3rd week of March to take clear policy decision with regard to dwellers of Dal Lake whose property was damaged in last year's devastating floods. A division bench of Justice Muzaffar Hussain Attar and Justice Janak Raj Kotwal passed the direction following perusal of a compliance report filed by Additional Secretary to Government Housing and Urban Development Department. "The government was required the State stand in respect of those Dal dwellers whose property was in the floods of September, 2014 but the compliance report has not any manner whatsoever, dealt with the court orders dated 27 November, 2014 and 16th December, 2014,' the division bench said and directed that the State Government, in order to save Dal Lake from further deterioration, has to take stand in the light of the observations made in order dated 27th November, 2014 and 16th December 2014. "For this purpose, we extend time and direct the state Government to take clear stand in the light of the aforesaid court orders on next date. Fresh compliance report shall be filed in this behalf," the division bench said. In another direction, the court also directed Pollution Control Board to file test analysis report about the water quality of the lake. The direction followed perusal of a compliance report by Mohammad Shafi Kanyu, Regional Director of the Kashmir Pollution Control Board, submitting that the floods of September caused extensive damage to the Board's infrastructure including laboratory, record and computers. He also stated that efforts were being made to make the Laboratory functional by end of February. He stated that to assess the water quality of Dal Lake, sample was taken onDecember 29 last year and was sent to Jammu Laboratory. "Nothing is said further as to what is the report of Jammu Laboratory," the division bench observed. Additional Advocate General R. A. Khan submitted that he has received some reports but they are not satisfactory. The AAG submitted that sample of water will be taken and same will be sent to Laboratory, Jammu for testing. "The compliance report shall be filed before next date positively," the court said |
