Shoddy investigation leads to acquittal of accused in NDPS case | | | Early Times Report
Jammu, Mar 4: Principal Sessions Judge Kishtwar acquitted two accused persons from charges under sections 8/20 NDPSA due to failure of prosecution to prove their guilt. While acquitting the accused Abdul Rashid S/o Gani Shah R/o Sigdi Chatroo and Gh. Qadir Mir S/o Ambir Mir R/o Gandol Kokarnag, the Principal Sessions Judge Kishtwar Miss Bala Jyoti observed the independent witnesses made totally contrary version than police had present and statements of the I/O and other police officials were not believable. Court also observed that the substance allegedly from their possession on 15/01/2014 out of which 100 gms of samples were taken, shall be dealt with under guidelines laid down therefore. There is no evidence that the substance unused by FSL was returned to police. Officials of Police Department may take appropriate action in this connection. Courts insisted for a 'must be true case' in order to entail conviction of the accused persons". As per police case Police team from Chhatroo recovered charas 1kgm each from accused persons on 15.01.2014 when they tried to give slip to police naka party of police. On search charas was recovered concealed under their pherns. (JNF) |
