Indian Constitution doesn't give the right to secede | Jammu & Kashmir | | Neha

JAMMU, Mar 4: Perverted novelist Arundhati Roy has been in her public speeches saying that "freedom of speech is non-existent and HR abuses are routine in Kashmir". She openly preaches sedition against India during her addresses. The last few days have also witnessed the likes of Roy, including Syed Ali Shah Geelani, Yasin Malik and so on, expressing similar atrocious views and criticized the People's Democratic Party (PDP) for thinking in terms of joining hands with what they called "anti-Kashmir" and "anti-Muslim" BJP. They termed the PDP as a "stooge of the Indian stage" and a party to the alleged move of the Sangh Parivar to "change the demography of the Valley". However, Roy, who renounced the Indian citizenship long back, is not an issue. Nor is her suggestion with regard to right to self-determination an issue. For, neither the Indian Constitution nor the J&K Constitution provides for right to self-determination. This is the constitutional position and no one can violate it. The Indian Constitution is like the American Constitution, which doesn't give the right to secede. The Indian Constitution is not like the constitution of the erstwhile Soviet Union, which had a provision that provided for secession of any of its federating unit. Article 1 of the Indian Constitution says that J&K is and shall always remain an integral part of India. Not just this, section 3 of the Jammu & Kashmir Constitution also says the same thing. The real issue is the freedom the likes of Roy enjoy to flirt with the Kashmiri terrorists and Naxal terrorists who miss no opportunity to attack the Indian State and its institutions. They visit the Valley at regular intervals, work shoulder to shoulder with Syed Ali Shah Geelani and others of his ilk and together with them preach sedition. The fact is that the likes of Roy, who could be legitimately termed as mercenaries and agents of hostile nations, accord legitimacy to the Kashmiri separatists and communal forces, thus creating complications for the Indian state in Kashmir. |
