Reframe JE grade-II list: HC to Govt | | | Early Times Report
Srinagar, Mar 5: The state High Court has directed government to work out vacancies of junior engineer grade-II after letting candidates selected by Service Selection Board an option for being appointed on the basis of the merit list. A single bench of the court comprising Justice M H Attar also directed the Service Selection Board to update and reframe the merit list as also the waiting list on the basis of information received from the appointing Authority about the vacancies which would become available after the joining of candidates on these posts. The Service Selection Board had issued three advertisements on December 28, 2012, February 18 and December 24 2013, inviting applications from the eligible candidates for being selected and appointed on the posts of Junior Engineers Grade-II. Subsequently, the SSB made recommendations to the Government for appointing the selected candidates on the notified posts. Many candidates later challenged the selection before the high court, citing a number of grounds. Advocate R.A. Jan, representing the aggrieved candidates submitted that to his information almost 192 candidates figure in all the three selections lists. He submitted that the Service Selection Board has committed error in law by making recommendations to the Government for appointing these candidates in all the three selection lists. Had the Board after publication of the all selection list obtained options from the selected candidates, he said, the candidates figuring in the waiting list would have no difficulty to find place in the merit list and others, who were not selected would have found place in the waiting list. He submitted that because of the "illegal and unreasonable exercise", the merit of the candidates who would have otherwise either figured in the selection list or waiting list, has become casualty. Advocate T H Khawaja, counsel appearing for SSB, submitted that prior to publication of the selection lists, Board decided to seek options from the selected candidates who figured in all the three selection lists, to ensure that one candidate does not figure in three or two lists to enable the SSB to recommend more candidates for being appointed on the posts of Junior Engineers Grade-II. "The controversy raised in this petition has narrowed down. It is only to be ascertained as to how many posts would become available after the candidates, who have been selected and appointed against more than one post, on the basis of his/her merit have joined on the appointed posts," reads an order by the court. In order to settle the controversy, the court directed government to issue public notice within four days, informing the selected candidates, who figure in more than one list to exercise their option for being appointed on the basis of the merit list, in which he/she figures. "After receipt of the options, the respondent no. 1 to issue appointment orders in favour of the selected candidates. Wherever appointment orders have already been issued and the selected candidates have joined, but they figure in more than one selection list, they can also exercise their option in the aforesaid manner," the court said. Thereafter, the court directed the government to work out the vacancy position which will become available in the exercise and thereafter request the Service Selection Board to update, reframe the merit list as also the waiting list and make fresh recommendations accordingly. The entire exercise, court said, shall be concluded within eight weeks. |
