HC raps govt for failing to revive fee fixation committee for schools | 'Will send Comm Sec to jail if he disobeys our orders' | | Early Times Report Srinagar, July 20: J&K High Court today pulled up the Education Department over its failure to appoint a former judge as chairman of a committee to fix fee structure for the private schools. Hearing a contempt petition, a division bench comprising Chief Justice N Paul Vasanthakumar and Justice Hasnain Massodi observed that it would send Commissioner Secretary of the Education Department to jail if he fails to comply with its orders. As the hearing started, Additional Advocate General S A Naik moved an application, seeking exemption of the Commissioner Secretary Shaleen Kabra from personal appearance till Thursday. Naik said Kabra was at the moment outside the state and would be able to appear before the court only on Thursday. "What is the difficulty in appointing the chairman of the committee? Who is not obeying the orders of this court? Name the officer," the division bench asked Naik. "We will furnish complete details about the steps taken from June 1 and the reasons as to why appointment of the judge was delayed," Naik replied. "Name the officer who is not implementing the court directions. In default, the Secretary will go to jail," the court replied, ordering the petition to be listed on June 23 with a direction to Kabra to remain present before it. "It is made clear that an affidavit to be filed shall give all the details about the steps taken from June 1," the division bench said. The court had directed government to nominate a former judge of the High Court as chairman of the committee set up in 2013 to fix fee structure of private schools in the state.
