Let Mufti make SAC & SHRC functional | | | When shall the PDP-BJP coalition Gov ernment make a number of commis sions active and functional? This question continues to bother people, political leaders and social activists because during the last several months a number of commissions have become almost defunct. Some of them have remained headless others have not been able to function because most of the members had completed their term. Well the coalition Government seems to be in no hurry in filling its commitment on providing transparent and honest Government. Well transparency and honesty may not depend on the style of functioning of the Chief Minister and his ministerial colleagues but on the working of various commissions, including the State Accountability Commission, the State Human Rights Commission. The State Human Rights Commission is defunct since June 28, 2014, after its last two members, Rafiq Fida and Amlok Singh, completed their three-year term. While the previous National Conference-Congress regime had called a couple of meetings of the high-powered selection panel headed by Omar Abdullah for filling the vacancies in SHRC, but they were cancelled at the eleventh hour - once due to imposition of Model Code of Conduct for parliamentary polls and at the other time due to boycott of Congress. The coalition government is yet to clear the appointment of SHRC chairman and members. Except bringing legislation during the Budget session to increase the age limit of chairman and members from 70 to 75 years and enhancing their term from three to five years, the government has done nothing in this direction. As a result of inordinate delay in appointment of chairperson and four members, over 1950 cases of human rights violations are pending disposal in the body. Likewise, the premier anti-corruption watchdog, State Accountability Commission, is also defunct since August last after its chairman, Justice (retd) YP Nargotra, and member, Justice (retd) Hakim Imtiyaz Hussain, completed their tenure. The Commission, which has the authority to take on bigwigs including Chief Minister and cabinet ministers, is still non-functional despite the fact that a Cabinet Sub Committee headed by BJP's Bali Bagat forwarded a list of six probables to the government more than a month ago. On June 26, the CSC shortlisted former Chief Justices, Bilal Nazki and Promod Kohli, for the position of Chairman SAC, while four former judges including Justice Sunil Hali, Justice JP Singh, Justice BL Bhat and Justice Bashir Kirmani were recommended for the post of SAC members. The only thing that the coalition Government has been able to do was to revive the Public Service Commission by appointing a new Chairman and five members. This was done because the Government has been keen on resolving the problem of unemployment. Instead of creating an atmosphere for speedy disposal of cases by the State Accountability Commission and the State Human Rights Commission the coalition Government seems to be a bit slow and lazy in making these two Commissions functional. Well one does not know what is the main hitch in finalizing the names of the chair person and members for the two commissions. Possibly it is the outcome of the usual style of functioning of the Chief Minister, Mufti Mohd. Sayeed, who has the habit of examining pros and cons of whatever decision his Government will take. Possibly he has been weighing the capacity of those who have been recommended by the Cabinet subcommittee for the post of chairmen and members of the two commissions. He wants to ensure that those selected had fair record as a human being, as a judge or as a bureaucrat. But there is limit to delays. Since the Government has already completed over seven months it will not have justification for delaying, making the two commissions functional. When the Government decided to have such commissions a due thought must have been paid towards the utility and necessity of these commissions. The PDP-BJP coalition Government is keen to bring various skeletons out of the cupboard of the previous NC-Congress coalition Government. It can do it provided all commissions are made functional. Once these commissions were made functional it would add to prestige of the Chief Minister, Mufti Mohd. Sayeed, who may win hearts of those who want to fight corrupt practices and human rights violations. |
