Pharmacists' selection: DB allows Govt to go ahead with probe through new one-man panel | | | Early Times Report
Srinagar Aug 25: The Division Bench comprising Chief Justice N Paul Vasanthakumar and Justice Hasnain Massodi today allowed the state government to go ahead with the one-member committee of inquiry but also directed it to keep intact the proceedings of the earlier committee for its perusal. The decision came in the wake of hearing of PIL alleging that Director Indian Science of Medicines (ISM) issued 'fake' certificates leading to the selection of hundreds of pharmacists in 2008 and that could also been used by some aspirants. The government order in this regard was produced by advocate general Jahangir Iqbal Ganie before a Division Bench of the high court comprising Chief Justice N Paul Vasanthakumar and Justice Hasnain Massodi. "The committee constituted (on 22-07-2015) for the conduct of enquiry in the subject case is hereby withdrawn abinitio," reads an order issued by secretary to government health and medical education department on August 24.It also reads, "Consequent upon above, Rajinder Singh Tara, Special Secretary, Health and Medical Education Department, is hereby appointed as Inquiry Officer to enquire into and to submit a factual report of the case forming the subject matter of the PIL, Abl Rashid Tantray Vs State & Ors," the order said, adding that the inquiry officer shall conduct an exhaustive enquiry into the fact and submit his report within a period of 15 days, enabling the health department to file a detailed reply in the PIL. On this, the Division Bench allowed the government to go ahead with the one-member committee of inquiry but directed it to keep intact the proceedings of the earlier committee for its perusal. Senior counsel, advocate Z A Shah, representing one of the respondents in the PIL, demanded the court to stop the media from reporting the case, claiming that it is been done 'negatively." However, the court turned down his requesting, saying 'media has own rights'. The petitioner, Abdul Rashid Tantray, has submitted in the PIL that director ISM in connivance with the top officials of the directorate of ISM in 2008 allegedly issued fake pharmacists diploma certificates to nearly 400 candidates, who got jobs under NHRM scheme. He pleaded that the certificates have been issued without making proper selection for training course of pharmacists. After a complaint was filed by some aggrieved candidates, the Government cancelled the list vide an order (No: 121 HME (GR 0f 2008)) on 17 October 2008. Subsequently, the backdoor selected candidates filed a petition in High Court which was dismissed with a direction to the Government to expeditiously frame and formulate the norms and procedure for making nominations for undergoing Dawasaz (pharmacists) training course. The Director ISM, the petitioner said, again violated the Court orders and issued diploma certificates to people without any training institute established in J&K. |
