SIC dismisses appeal against its own PIO | | | Early Times Report Jammu, Aug 31: The State Information Commission (SIC) has dismissed an appeal filed by a Jammu resident against the order of the Public Information Officer (PIO) of the SIC. Details available with Early Times reveal that one Gurdev Singh, R/O Nanak Nagar, Jammu-180004 submitted an RTI application dated 12.02.2015 before the PIO/J&K State Information Commission, Jammu under State RTI Act, 2009 seeking certain information with respect to the second appeals filed in the Registry of J&K State Information Commission (SIC). The appellant sought some information related to disposal of his second appeal filed before the SIC sometime back. The information was sought from the Deputy Secretary of SIC who happens to be the PIO of the State Information Commission (SIC) as well. During the course of proceedings held at Jammu office of SIC on 19.8.2015 today, the PIO of SIC, Jammu submitted that he has provided the information to the appellant vide letter No.SIC/PIO/57/2015/79 dated 06.03.2015. The PIO also informed the information seeker that his second appeals were found deficient and as such could not be listed for hearing before the Commission and the copy of the deficiency notices issued by the Commission were also provided to the appellant. The appellant feeling aggrieved of the order of the PIO, filed first appeal before the First Appellate Authority (FAA) ie Registrar, J&K State Information Commission on the ground that the information provided to him by the PIO was incomplete. The First Appellate Authority observed that the appellant be given seven days time to remove the deficiencies found in the above said second appeals and thereafter the appeals shall be listed for hearing. However, the appellant challenged the aforesaid order by filing second appeal before SIC. The Commission after receiving the second appeal listed the matter for hearing on 31.07.2015 and 19.08.2015. On both the dates of hearing, the appellant opted to remain absent inspite of the fact that hearing notices were duly dispatched to him at the residential address given in the second appeals. The appellant according to SIC officials was also contacted by the office of the Commission telephonically to present his case before the Commission and on both the occasions, he informed the office of the Commission that he is in Chandigarh and hence unable to appear before the Commission. "From the aforesaid facts and submissions made by the PIO of J&K SIC, Jammu, it is clear that the appellant complied with the orders of the First Appellate Authority and removed the deficiencies in his second appeals and after that all the second appeals were listed and disposed of by the Commission. The present second appeal is not maintainable, as the reply to the RTI application of the appeal was provided well within the statutory period and as such no further direction in the matter is required. The appeal is accordingly disposed of" reads SIC order. |
