HC directive to Com- JMC, UEED CE | Alleged encroachment of nallah by Raman Bhalla, others | | Early Times Report
Jammu, Sept 3 High court judge Tashi Rabstan today directed JMC commissioner and UEED chief engineer to file status of petitioner's representation dated July 28, 2015 made in the form of a legal notice seeking demolition/removal of encroachments made by ex-revenue minister Raman Bhalla and others on the nullah near Satyam Resorts at Deeli here in terms of J&K Water Resources (Regulation and Management) Act, 2010. Justice Rabstan issued notices to Commissioner/Secretary Housing and Urban Development Department, Commissioner/Secretary Irrigation and Flood Control Department, Divisional Commissioner, Jammu, Deputy Commissioner, Jammu, JMC Commissioner, UEED chief engineer, SE ,Sewerage and Drainage Circle (UEED), Narwal, Xen, Sewerage and Drainage Division (West) Narwal Jammu, AEE Drainage Sub-Division No III (West) Narwal and Raman Bhalla. It was submitted that Bhalla had constructed a palatial house near Satyam Resorts and also raised a huge bund on the nullah coming from Trikuta Nagar Jammu for making alternate pathway/entrance to his residence when according to the approved building plan of JMC the entrance is from different side. It was alleged that the alternate pathway was made by him by encroaching the nullah which is not permissible in terms of J&K Water Resources (Regulation and Management) Act, 2010 and as per the mandate of the said Act no masonary/ earthwork can be carried out on a nullah/ Drainage by anybody as any such construction or work can only be undertaken by the concerned XEn/AEE. It was also submitted that the encroached area was being used by Bhalla for parking and for the picket of his security personnel. It was argued that encouraged by the encroachment made by Bhalla and the criminal silence adopted by JMC and UEED, the other influential inhabitants of the area had also encroached the same nullah for creating entrance to their commercial establishments like Banquet Halls and the officers/officials of JMC and UEED are required to be proceeded against under J&K CCA Rules, 1956 for allowing such encroachments in broad day light when they are statutorily bound to check and prevent such encroachments on nullahs/ drainage/ water bodies. Justice Rabstan then directed JMC commissioner and UEED chief cngineer to file status of petitioner's representation made in the form of a legal notice seeking demolition/ removal of encroachments made by Bhalla and others on the nullah near Satyam Resorts in terms of J&K Water Resources (Regulation and Management) Act, 2010.
