Penalty notice slapped on SSRB's Sr Law Officer | Denial of Information under RTI | | Early Times Report Srinagar, Sept 8: The State Information Commission has issued a penalty show cause notice against Senior Law Officer of State Services Recruitment Board (SSRB) for not providing information to an applicant under RTI Act. Details available with Early Times reveal that an RTI applicant namely Deepak Chabra, a resident Uri Baramulla approached the State Information Commission (SIC) with his 2nd appeal under Section 16 of the J&K, RTI, Act, 2009. He prayed for issuing direction to the PIO SSRB to provide him information related to some appointments made by SSRB. The appellant had filed an RTI application before PIO, JKSSB, received on 02-05-2015, seeking information about selection of teachers in Baramulla and points scored by some candidates in written test and viva. The information was denied to the information seeker until the SIC issued notices against SSRB. The order under Section 7, giving response to the RTI application was to be passed by or before 01- 06-2015, as prescribed under the Act. As the appellant did not receive any response from the PIO, he preferred first appeal before the First Appellate Authority (Secretary SSRB) on 02-06-2015. The FAA did provide opportunity notice to the appellant of being vide his letter dated: 09-07-2015 before adjudicating his appeal. But appellant did not attend FAA's office. The Secretary BOSE ie First Appellate Authority (FAA) was under legal obligation to adjudicate this appeal on the basis of facts of the case and record available. However, he did not adjudicate this appeal. Having not received any response from FAA, appellant approached State Information Commission (SIC) with his 2nd appeal. SIC in its judgment ruled, "During the case hearing Javid Ahmad, Senior Law Officer-cum-PIO, JKSSB informed the Commission that information has been dispatched to the appellant vide no. SSB/452/15/Adm/RTI/452/15/512 dated: 10-08-2015 by speed post. Since, information has been sent far beyond the statutory period of time, as prescribed under the Act, Mr. Javid Ahmad, Senior Law Officer-cum-PIO, JKSSB is directed to explain why penalty under Section 17 of the J&K, RTI Act, 2009 may not be imposed on him for providing information beyond the statutory period of time. His reply, if any must reach the Commission within 30 days of the receipt of this order.Appellant to intimate Commission of the receipt of information and inform Commission whether complete and correct information has been provided by the PIO" |
