HC disposes of PIL seeking effective prosecution of criminal trials | | | Early Times Report
Jammu, Nov 19(JNF): In a PIL, seeking a direction to initiate urgent steps for efficient investigation, effective prosecution of criminal trials, particularly involving capital sentence with a view to prevent crime and to convict the offenders by making punishment a real deterrent, a high court division bench of Chief Justice N Paul Vsanthakumar and Justice Dhiraj Singh Thakur disposed of the petition with a direction to the respondents to take a decision with regard to the guidelines and norms for appointment of Public Prosecutors (PPs), Additional Public Prosecutors (APPs) and Special Public Prosecutors (SPPs). It is contended by the petitioners that inefficiency or lack of integrity on the part of Public Prosecutors not only affects the society but may also reflect sadly on the judicial system as held by the Supreme Court. It is further contended that the state government has to ensure that prosecutions are able to perform their functions without intimidation, hindrance or harassment. The petitioners have also stated that in spite of engagement of PPs and APPs, the government is engaging SPPs to defend several cases as there is no policy and guidelines framed by the government to appoint PPs and APPs. The bench, after hearing the two sides, disposed of the petition with a direction to the respondents to take a decision with regard to the guidelines/norms for appointment of PPs, APPs and SPPs bearing in mind the Supreme Court judgment along with the report of the committee and the suggestions made by this court and finalise the norms within a period of four weeks from the date of receipt of copy of this order and till such time no PPs, APPs and SPPs shall be appointed. --JNF |
