DB upholds writ court judgment over higher Pay-scale to SFC employees | | | Early Times Report Jammu, Nov 20: In an LPA filed by Jammu and Kashmir State Financial Corporation, through its Managing Director (MD) challenging the writ Court order whereby Writ Court directed SFC to release Higher Standard Pay Scale as per SRO 14 of 1996 dated 15/01/1996, a Division Bench (DB) of state High Court comprising Chief Justice N Paul Vasanthkumar and Justice Bansi Lal Bhat after hearing both the sides dismissed the LPA and uphold the judgment of writ Court. Division Bench (DB) of state High Court observed that It is not in dispute that vide SRO 14 of 1996 dtd 15/01/1996, the State Government has ordered higher standard pay scales to the employees of State Government. Division Bench also observed that the perusal of the above recommendations which were accepted by the State Government and order having been issued, it is not open to the appellant to contend that the Board of Directors has decided to defer the decision and the decision to grant Higher Standard Pay Scales having been recommended by the Board of Directors, which was accepted by the State Government and an order having been passed to that effect, the respondents are justified in demanding the Higher Standard Pay Scales which were rightly ordered by the Single Judge. With these observations Division Bench dismissed the LPA and upheld the judgment of writ Court. (JNF) |
