After Sajad Lone, Taj's shopping complex sealed | | | Early Times Report
Srinagar, Dec 20: In compliance with the High Court directives, the Srinagar Municipal Corporation today sealed the 5-storey shopping complex owned by former Minister and senior Congress leader Taj Mohi Din in the heart of Srinagar. "The commercial space that belongs to Taj Mohudin S/O Khuda Bakshi R/O Gupkar road S/A Residency road Srinagar was sealed in presence of Secretary SMC Hilal Dewani, Chief Enforcement Officer Syed Nisar and various enforcement officers and the sealing assisted by Kothi Bagh Police Station," the SMC officials said. A SMC official told Early Times that a huge contingent of police was deployed in the area to prevent any resistance from the Congress leader or his son in law who is believed to be running some business ventures there. The complex was constructed when Taj was a cabinet Minister during the previous Omar Abdullah regime. Earlier this month, the SMC sealed the shopping complex owned by the family of separatist leader-turned- Minister Sajad Gani Lone. The shopping complex is in the name of his two sons. Today as the sealing of Taj's complex was going on, some people who assembled in the vicinity shouted "discrimination." They said the complex owned by family of another politician who is in power this time has not been sealed in the nearby Sheikh Bagh locality. "There has been so much of favoritism that the officials didn't even mention name of the Shiekh Bagh building in the list for sealing only because it belongs to Minister who got his choice of officers posted in SMC," the protesters believed to be Taj's lobby shouted. On December 17, the High Court directed SMC to seal a commercial complex of the top Congress leader. A division bench of the High Court said prima facie, it appears that the petitioner (Taj Mohi-ud-Din) committed serious breach of permission granted to him for raising of construction as he has not maintained car parking in the complex, which was the fundamental condition for permission. Earlier, SMC had informed the court that the petitioner made blatant violation of civil laws as the permission granted to him was on the condition that the ground floor of 5-storyed building will be used for car parking facility but he utilized the said space for commercial purpose. SMC, however, said that they couldn't seal the complex owing to a court order. The High Court had earlier issued show cause notice to the Minister but he had approached J&K Special Tribunal against the court notice but the tribunal too dismissed the plea. The High Court said "J&K Civic Laws (Special Provisions) Act, 2014, does not extend protection to the type of violations, which the petitioner has committed and when his case stands decided by the quasi-judicial authority much before coming into force of the said Act." "No person can be permitted to reap benefit of his illegal actions," court said. The bench observed that the civic laws are made for the benefit of general public and the commercial interest of one individual cannot be permitted to ride roughshod on the civic rights of general public. The petitioner cannot, after seeking benefit of civic laws and the permission granted to him, turn round and challenge the very law when action is initiated against him for committing its violation. The court vacated the earlier writ petition filed by the former minister and asked SMC to seal the commercial complex and said that it shall remain sealed till further orders from the Court. |
