'Khyber Agro Industries endanger human lives' | CJM Budgam imposes fine of Rs 9 lakhs | | Muhammad Mukaram Early Times Report Srinagar, Apr 5: The leading business tycoon Khyber Agro Industries pvt Ltd has been held liable of endangering peoples' lives by marketing adultersted milk. Chief Judicial Magistrate Budgam has imposed a fine of Rs 9 lakh on Khyber Agro Farms Private and a nominated officer would also have to undergo an imprisonment of six months. The directions were passed after samples of toned milk (Khyber brand) collected by Food Safety Officer Zeenat Ayoub turned out to be substandard after analysis. Chief Judicial Magistrate Imtiyaz Ahmad Lone directed the Commissioner, Food and Safety Act, to take immediate steps in ensuring that the company products taken off from the market unless Referral Laboratory Kolkata declares that the products are safe to consume . The samples tested by Referral Food Laboratory, Kolkata confirmed the presence of detergent in the milk and also showed the milk fat lower than the prescribed levels. According to the report, the sample also contravenes Food Safety and standards (packaging and labelling) Regulations. Pertinently, Court held the accused company guilty and convicted through its In-charge Operations nominated person Mohammad Shafi Ganie. The company has been convicted under Sections 51, 52 and 59 of Food Safety Standards (FSS) Act -2006 943 of 2006). The court imposed fine of Rs 5 lakh for selling Sub-Standard food, Rs 3 lakh for 'misbranded' item and Rs 1 lakh for selling unsafe food. Further, the judgement ruled out 'the presumption of innocence in favour of the accused company' on the grounds that the company is facing similar cases before various courts. The court described Food Analyst Kashmir Hamidullah Dar as 'either incapable or dishonest', for he gave 'clean chit' in favour of the accused company. "A person like Hamidullah Dar is more dangerous than fatal disease like cancer for the entire nation and incapacity or compromise with the nature of job like Food Analyst Kashmir cannot be accepted by any standards of expectation where lives of citizens are involved," the judgement reads. While adding that need of the hour is to remove Dar from 'present assignment' and to initiate a process against him to declare Dar as 'deadwood'. "I feel pained to describe how our society has been subjected to silent injury by permitting convicted company to earn profit at the cost of the lives of consumers. Only God knows how many people might have died by consuming detergent in Khyber milk'' the judge held. |
