APD issues order in violation of HC orders, allege Agri officers | | | Early Times Report
Jammu, Apr 28: Jammu and Kashmir Agriculture Gazetteed Officer have alleged that the recent order of transfer and postings issued by Principal Secretary, was in total violation of repeated orders of Higher Court and the silence of Minister over the issue was most intriguing. Explaining further, the officers said that the vide his order No: 141-Agri of 2016 dated: 27/ 4/2016, Principal Secretary issued transfer /posting order of Agriculture officers, in total violation of three standing court judgments titled Chiranjeevan Razdan v/s State & others at Jammu & K.K. Sharma & others v/s State & others at Jammu and Mohd Mubarak Rishi and others v/s state & others at Srinagar and final verdict of all these judgments issued during April 2010, April 2011 & January 2014, which were in favour of upholding the G.O. No: 279 Agriculture of 2008 dated: 7/10/2008. "Besides already three judgments and subsequent three contempt petitions are pending against non compliance by APD for implementation of G.O. No: 279 Agri of 2008 dated: 7/10/2008. But principal secretary issued order in its violation and has not shown any level of maturity while issuing such alleged G.O. whereby the Agriculture officers holding their class-I positions in one district is transferred and posted as subordinate /junior position in other district without considering eligibility of the officer of Agriculture Department which is clear and evident from the present order", they said. They further said that the APD was bound by law to consider the Agriculture officers' eligibility out of the G.O. No: 279 whereas by way of issuing present order the officer shown at S. No. 1 to 13 were cleared in different cadres. "The HC orders have been rubbed under the mighty foot of the state rulers where under justice seekers are thrown to the walls like anything", they said. They further said that it was very much clear from aforementioned status chart that G.O. No: 279 of 2008 were giving the genuine and legitimate positions to the Agriculture officers which at least should have been adhered to but the APD was hell bent to deprive of the legitimate justice to the Agriculture officers. They appealed Minister for Agriculture and Principal Secretary APD to intervene immediately in the matter and restore G.O. No: 279 Agri of 2008 dated: 07.10.2008 which is even now a permanent solution of the long pending grievances which too has been upheld by HC. |
