CS appears in HC, assures to set up food testing labs | HC defers action against food officers after assurance | | Early Times Report
Srinagar, May 14: Chief Secretary B R Sharma and other senior officers today appeared before a division bench of high court during the hearing of a suo-moto PIL. In all fairness, Sharma admitted that the Food Safety and Standard Act, 2006 had not been implemented in the state in the manner it should have been. He said he would immediately take review of all the aspects concerning the implementation of FSSA. He also assured that without waiting for the financial assistance from Centre, funds for setting up technologically advanced laboratories both at Jammu and Srinagar would be immediately provided by the state and the labouratories would be established shortly and that a mobile testing lab would be provided to the concerned department in terms of legislation which would also be put in place shortly. "In view of the assurance given by the chief secretary, we defer recommending initiation of disciplinary action to be taken against the authorities who failed to implement the Act of 2006 till date," the division bench of Justice M H Attar and A M Magrey said. The bench observed that authorities were required to show sole deep concern to ameliorate the sufferings of people due to food adulteration. "The authorities whosoever have been involved at different points of time in implementing the Food Safety and Standard Act of 2006 have exhibited only skin deep concern to the sufferings of people. The state authorities in order to ameliorate the lot of suffering people are required to show sole deep concern," the bench observed. Last week, the court had directed personal appearance of chief secretary and senior functionaries because authorities under FSSA 2006 stated that two existing food testing laboratories in the state, one each in Jammu and Srinagar, were not only outdated but literally non-functional. In another direction, the bench directed Khyber Agro Farms Private Limited to file an undertaking that in case the company's food items were found adulterated, it was liable to be sealed. "The managing director, Khyber Agro Farms, to file the undertaking in terms of (previous) court order before the next date," the court said, adding that if the Khyber and other companies failed to file the undertakings, appropriate orders will be passed on next date of hearing. In another direction, the court directed owners or MDs of food manufacturing or processing units to file affidavits, indicating as to how and in what manner, they were following the provisions of the FSSA 2006.
