HC displeased over denial of govt accommodation to specially abled lawyer | Directs personal appearance of Director Estates | | Early Times Report Jammu, May 20: High court judge B S Walia today expressed displeasure over the delay caused in implementation of November 27, 2012 high court order whereby a direction was issued for allotment of residential accommodation to a specially abled lawyer. He also directed Director Estates to remain personally present on the next date of hearing to explain the reasons for not complying with the court directions. Justice Walia said in case director estates "files compliance report before the adjourned date of hearing, he needs not to appear in person". Looking into the seriousness of the issue, he directed the registry to list this petition in the week commencing May 30, 2016. Earlier, visually impaired lawyer Suraj Singh submitted that despite the November 27, 2012 high court direction to consider allotment of residential accommodation to him as per the mandate of J&K Estates Department (Allotment of Government Accommodation) Regulations 2004 and J&K Persons with Disabilities (Equal Opportunities, Protection of Rights and Full Participation) Act, 1998, the estates department had miserably failed to implement the high court order even as only two weeks had been granted to it to comply with the court directive. He drew the court attention towards Regulation No 4(e) of J&K Estates Department (Allotment of Government Accommodation) Regulations, 2004 which provides 5 pc discretionary quota placed at the discretion of the minister for estates for persons other than government employees which includes freedom fighters, ex-legislators and media persons. He said he was the only visually impaired lawyer in the Jammu province who was practising in the high court and he had approached then chief minister by way of September 1, 2012 representation for allotment of a suitable accommodation. |
