HC directs state to adopt rules, file status report | PIL on implemtation of Plastic Waste Management rules | | Early Times Report Jammu, Aug 9: A high court division bench of first puisine judge Ramalingam Sudhakar and Justice B S Walia today directed the state to adopt foolproof rules of plastic waste management and file the status report within three weeks. The court directive came in a PIL, seeking direction to state to promulgate rules in line with Plastic Waste Management Rules-2016 promulgated by the union ministry of environment, forest and climate change vide GSR 320 (E) on March 18, 2016, more particularly conditions with respect to manufacture, import, stocking, distribution, sale and use of carry bags, plastic sheets or covers made of plastic sheets and multi-layered packaging not less than 50 microns in thickness being safe for environment so that J&K was free from the menace of circulation and use of cheap and non-biodegradable plastic. The petitioner submitted that even when citizens try to manage their plastic bag disposal, wind 'plays a role in carrying them away as litter which is not biodegradable and thus where it lands, it tends to stay for a long period of time. A bag that is eventually ripped to shreds from high winds or other factors doesn't disappear but instead is spread in smaller amounts throughout the area. This can cause more problems as these smaller pieces are carried away through storm and often end up in the waterways. With more than 500 billion and possibly as many as a trillion plastic bags in circulation annually, this could lead to a catastrophic littering problem. Not only is littering unattractive but it is also a very serious environmental hazard and the indefinite period of time that it takes for the average plastic bag to breakdown can be literally hundreds of years. Every bag that ends up in the woodlands of the country threatens the natural progression of wildlife', he submitted. Because the break down rate was very slow, the chances that the bag would harmlessly go away were extremely slim. "It is estimated that one bag has the potential to unintentionally kill one animal every three months due to unintentional digestion or inhalation," he submitted. |
