For denying admission to student, HC imposes cost of Rs 10,000 on JU | | | Early Times Report Jammu, Sept 7 : A high court division bench of Chief Justice N Paul Vasanthakumar and Justice Tashi Rabstan today imposed a cost of Rs 10,000 on Jammu University (JU) for erroneously not admitting a student in its law school under Bharat Scouts and Guides category. The court directive came in a LPA filed by the JU vice-chancellor and others, challenging a single bench order whereby it had directed them to provisionally admit Amman Shafqat Mirin in the JU's law school for pursuing five year LL B course under Bharat Scouts and Guides category for 2015-16 session. The bench dismissed the appeal with the observation that petitioner was declared entitled for admission in the law school of JU under the reserved seat of Bharat Scouts and Guides category. How to adjust Pranav Sharma, if any candidate has been admitted against the self financing vacancy which was initially occupied by him, had to be decided by the JU authorities as they were responsible for creating such a situation, the court directed. As the petitioner was undergoing the law course in a private law college affiliated to JU, the bench directed respondents to transfer and admit him forthwith in the JU's law school against the reserved category seat of Bharat Scouts and Guides in the current semester and count the attendance earned by him in the private college as attendance earned by him in the JU's law school for the purpose of appearing in examination, the bench said. "The petitioner is also held entitled to a cost of Rs 10,000 to be paid by JU as he was forced to study law course in a private law college due to erroneous approach of the university officials.(JNF) |
