HC grants 2-week time to implead DC as party respondent | Alleged encroachment of forest land by minister | | Early Times Report
Jammu, Oct 8 : In a petition filed, seeking registration of FIR under section 5(2) of J&K Prevention of Corruption Act against sitting minister Abdul Ghani Kohli and officials of revenue and forest departments for allegedly grabbing more than 10 kanals of forest land under khasra No 356 min at Nowabad, Sunjwan, a high court division bench of Chief Justice N Paul Vasanthakumar and Justice Tashi Rabstan today granted two weeks' time to implead deputy commissioner, Jammu, as a party respondent. The court directive came when the petitioner submitted that according to the SVO status report, DC, Jammu, was not cooperating for completion of investigation. The petitioner drew the court attention towards his June 16, 2015 complaint which he had filed before SVO director and VOJ SSP, seeking registration of FIR under section 5(2) of J&K Prevention of Corruption Act against the minister and officials of revenue and forest departments for allegedly grabbing more than 10 kanals of forest land at Nowabad. He argued that as per the SC directions in case the titled Lalita Kumari v/s State of UP, the vigilance organisation was under a bounden obligation to register FIR against the minister as his complaint disclosed the commission of cognizable offences or in the alternative, the SVO should have finalized the preliminary enquiry within seven days as prescribed by the Apex Court, but neither the FIR was registered nor the preliminary enquiry was finalized solely because of the reason that the accusations were directed against a sitting minister. He alleged that the minister had raised a huge infrastructure on the encroached forest land in the shape of a B Ed college, a paramedical institute, a branch of J&K Bank Ltd and an ATM. "SVO seems to be under pressure to proceed against the minister as the officers of SVO are accountable to GAD being servants of the state," he alleged. He also pressed for constant monitoring of the preliminary enquiry by the high court, looking into the gravity of the allegations and the position enjoyed by the 'encroacher'.(JNF) |
