Early Times Report Jammu, Mar 29: To benefit some 'blue eyed', the district administration Poonch has reportedly changed the alignment of PMGSY link road from Kotian to Gulhota, prompting the High Court to direct the Revenue department to construct the road as per approval of competent authority. Mohammad Sagheer, a local resident, told Early Times that the officials of PMGSY and tehsil administration have diverted the link road from its original design. It is surprising though the administration has given land compensation to people as per approval of competent authority but the road was constructed in violation of the original design. "One Manzoor Hussain filed writ petition in court for change of road alignment in 2015 and the review petition was listed before the Division Bench on April 25, 2016. After hearing the parties the court dismissed the petition and directed the executing agency to construct the road as per its original design", Sagheer said, adding that despite direction of court the PMGSY officials and district administration changed alignment and constructed the road. Later, Sagheer filed a writ petition on November 2017 in which he sought directions to the concerned to construct the road strictly in accordance with the alignment in compliance of notification dated 03-10-2012 issued under section 4 of the land acquisition act for acquiring the land falling under Khasra Nos. 13, 62, 15, 16, 59, 54, 55/1, 18, 28, 55, 58, 57, 29, 24, 23, 35 and 37, situated at village Kotian, of tehsil Mendhar. He further sought direction to the administration to not to change the alignment for the construction of road from Kotian to Gulhota. The matter was taken March 28, 2018. However, the respondents are changing the alignment for the construction of the road. "It is further submitted that writ petition be disposed of with the directions to the respondents not to change the alignment of the road without obtaining approval of the competent authority, in light of the directions passed by the division bench of this court in LPAOW No.66/2014," the petitioner pleaded. "In view of the aforesaid submissions and in the facts of the case, the writ petition is disposed of with the direction to the respondents not to change the alignment of the road in question without obtaining approval of the competent authority," the court observed. |
