KATHUA, Apr 24: Seven private schools from thus district have challenged District Magistrate (DM) Kathua's Section 144. The prohibitory orders have been stayed for these schools till the next hearing of this case. Reports said that Mount Litera Zee School, Logate Morh, Kartar Public School, Barnoti, Indian Public School, Kalibari, D S Heritage School, Barwal Morh, Sai International School, Hiranagar, DAV Collegiate School, Lachhipur and Jammu Sanskriti School, Kathua approached the High Court seeking relief in the order. After hearing counsel petitioners High Court stayed the imposition of 144 Cr PC. The High Court orders reads as, "Learned counsel for the petitioners submits that petitioners schools are unaided institutions and the magistrate has no power to invoke the power under section 144 the code of criminal procedure and to pass the impugned order dated 5-4-2018. In view of the aforesaid submissions and in the facts of the case, it is directed that operation and effect of the impugned order is so far as it pertains to the petitioners shall remain stayed till next date of hearing." |
