JAMMU, May 1: The State Information Commission has reportedly regularized the service of a driver, which is allegedly an illegal appointment as neither the post of driver was forwarded to any recruitment agency nor advertised for fair selection.
According to an order (NO. 12-SIC(CO) of 2018 dated 2/2/2018,) the SIC has regularized the services of a driver Bashir Ahmed Lone, who had been engaged to ply the vehicle of department for last many years.
Lone was engaged to ply the departmental vehicle for a period of six months with effect from 28/4/2011 as mentioned in order number 15-SIC of 2011 dated 16/6/2011.
"Prior to the amendments made to the RTI Act in the year 2012, the Commission was empowered to utilize certain services on outsource basis. M/S United Placement and Security Services Pvt Limited through a pact relieved Bashir Ahmed from their establishment with the direction to report to the commission to ply the departmental vehicle.
"There are 4 posts of drivers sanctioned for the Commission out of which 2 were filled and the rest two are lying vacant as on date", the order reads.
According to the order, despite cessation of the pact on 27/10/2011, the services of Lone were continued to be used by the Commission. "……the commission has extended the term of the concerned driver time and again leading there by the continuity of his services without any break", it reads.
Giving a vague argument, the Commission order stated that the driver had lost precious period of his life in serving the Commission with zeal, dedication, honesty and devotion and has lost all the chances of competing in the open market to earn his livelihood.
Moreover, picking holes in the utilizing the services of driver, the order stated that although serving in the Commission for 7 years no approval for continuation or regularization has been accorded in his favour.
"Therefore keeping the above facts in view and as approved by State Chief Information Commissioner the services of Bashir Ahmed Lone, driver is hereby continued as consolidated paid worker against the clear vacancy of the driver and being a skilled worker his wages are hereby regulated in terms of SRO-460 of 2017 dated 26/10/2017 with immediate effect", the order ends.
