JAC assails Modi Govt for advocating reservation in promotions

Jammu, June 20: Joint Action Committee (General category) assailed Modi Government for advocating reservation in promotions. Joint Action #committee J&K (General Category) ,JKGCWF ,Aarakshan Virodhi Manch jointly today held an strong but peaceful protest here in Exhibition Ground Jammu against the circular issued by Central Government asking states to implement Reservation in Promotions. Ved Prakash Sharma, Convenor JAC strongly condemned the action of Modi Government as it was illegal and unconstitutional to grant reservation in Promotions without following laid down law. The directions of central government tantamount to seeking murder of Merit and Seniority, muzzling the right to equality and justice.-The circular issued by central government is political in nature and far from premises of law and justice. The matter being subjudice in Supreme Court has been swept away by a illegal circular of central government which seeks to sideline the Rule of law pertaining to the Reservation in Promotions. "We general category people stand united on this issue in support of the general masses all over the country. It is pertinent to mention that the orders of supreme court have been mis-represented and soon this illegal circular shall get quashed by the court," they said. As far as state of Jammu and Kashmir is concerned the sovereignty of Constitution of Jammu and Kashmir which is guaranteed by Article 370 under the Constitution of India and upheld in various judgments of supreme court gives immunity against any amendments even if passed by centre and are not directly applicable to this state. Madan Lal Narad of AVM informed that High Court of Jammu and Kashmir in its landmark judgment dated 9.10.2015 in the case titled Ashok Kumar Sharma Vs State Of J&K had quashed the reservation in promotion rules abnitio. The judgment has been delivered based on the two premises. One was that 77Th Amendment of Constitution of India was not extended to the state of Jammu and Kashmir and accordingly Article 16(4) which grants reservation in Promotion does not get directly implemented in the state of Jammu and Kashmir.
