'Government should realise urgency of rape cases' | FAST TRACK TRIAL FOR RAPE CASES | | Early Times Report Jammu, June 20: Overlooking the gravity of rape cases which are piling up in various courts across the state, the government appears to be in deep slumber, as the delay in their disposal is pushing the victims into depression. Hence, fast track trials for early disposal of such cases have become the need of the hour. Priya Charak, a student, said: "It is very unfortunate that we are still living in patriarchal society and the incidents of rape become a social stigma for women due to which many cases are not reported by the victims for fear of the insult in the society even no fault of her. "When society closes its eyes from such sensitive issues, rapes continue to take place and the only place which left for the victim to get her dignity back in the shape of justice is the court of law. But the delay in the disposal of the rape cases due to pendency of such cases makes her life difficult. Priya Charak said there are a number of stringent laws pertaining to rape cases in the constitution but the issue is their implementation on the ground. "The government should realize its duty to take all necessary and urgent steps in this connection by setting up special cell for fast track trials," she said. She said the time has come when common people as well as the government should understand the severity of such cases and take prompt steps to hold fast track trials in rape cases so that justice can be done with the victims. "Unfortunately, our state is still away from setting up of fast track courts to hear the rape cases," she added. "There is a very famous 'Vishakha Judgment' on harassment of women in workplace after which many committees were constituted. But shockingly the recommendations of the committee were not implemented in full spirit, thereby it becomes imperative to constitute a constitutional body by setting up special cells to deal with rape cases for fast track trials and female judges should be appointed for hearing the cases," Priya Charak said. She maintained that nobody can imagine the psychological state of mind of a rape victim and the trauma she is passing through, which totally demoralize her, and only way to provide relief to the victim in the shape of justice by disposing of cases on fast track trials. "How can we consider ourselves a part of a civilized society when a few months old girl child to 90-year-old women are raped, but shockingly in our society, a rape victim is held responsible for the incident. Only capital punishment for such crime is not sufficient and the ultimate solution but we need is to sensitize ourselves. To check such incidents there should be a counsellor at every school to create awareness among the students." Anju Sambyal, a housewife, said that the delay in the disposal of rape cases encourages other criminals who feel no fear in committing such heinous crimes. "Hence it becomes necessary to dispose of rapes cases through fast track trials, and for that fast track courts should be established across the state," Anju said. She said: "There are umpteen instances when victims and their families are threatened by the accused to withdraw cases. Therefore, early disposal of rape cases has become necessary," she said, adding that if the victim is poor then the justice becomes a far-fetched dream for her. "The government and its machineries like police and court should take honest steps to the handle such sensitive cases. No doubt judiciary plays vital role in providing justice to the victim but the pendency of the rape cases in various courts due to lack of special courts and prolonged cases pushes the victims to depression," Anju said. She said that early justice will encourage other victims also to take course of law. Poonam Manhas, a teacher, was of the opinion that there should be fast track trials for rape cases and government should not take such issue lightly and should establish fast track courts across the state. "Rape cases should be disposed of in a time bound manner and should not take more than six months to one year. More importantly, parents should sensitize their children towards this heinous crime," she said. |
