DB directs Home Secy to provide adequate security for removal of encroachments | | | Early Times Report Jammu, July 4: In a Public Interest Litigation filed by Jagidsh Chander Gupta to highlight the illegal encroachments by the shopkeepers and other unknown persons in the JDA Shopping Complex, Mohalla Old Hospital Road, Near City Chowk, Jammu and also in the area adjoining the same, A Division Bench of State High Court Comprising Acting Chief Justice Alok Aradhe and Justice Dhiraj Singh Thakur after hearing Adv Ajay Sharma appearing for the PIL whereas Sr. AAG SS Nanda appearing for the State whereas Adv Sachin Gupta appearing for the JMC and Adv Adarsh Sharma appearing for the JDA, directed Commissioner/ Secretary to Government, Home Department, Government of Jammu and Kashmir shall ensure that adequate police protection is provided to the officers of the Jammu Municipal Corporation and Jammu Development Authority for removal of encroachments. DB further directed Commissioner/Secretary to Government, Public Works Department, Government of Jammu and Kashmir shall also extend its full cooperation in ensuring the removal of encroachments and shall also ensure that the areas from which the encroachments are removed shall not be encroached again. Division Bench observed that vide Order dated 28.03.2018, Jammu Municipal Corporation as well as Jammu Development Authority were directed to submit the compliance report. In compliance of order dated 28.03.2018, the compliance report has been filed only by the Jammu Municipal Corporation. The compliance report lacks in material particulars. The Jammu Municipal Corporation is required to mention the action taken by it giving the details thereof. Therefore, we deem it appropriate to direct the Municipal Corporation Jammu, to submit the report in the tabulated form indicating the area in which the encroachments are existing and specifically the action taken with regard to removal of each encroachment by the Jammu Municipal Corporation. Division Bench directed that the Commissioner/ Secretary to Government, Home Department, Government of Jammu and Kashmir to ensure that adequate police protection is provided to the officers of the Jammu Municipal Corporation and Jammu Development Authority for removal of encroachments.
