HC grants Govt more time to revisit prison rules | | | Early Times Report
Srinagar, Dec 17: The state government on Monday sought more time to revisit the existing Prison Rules and take a view as to whether the changes need to be effected in the light of the directions passed by the Jammu and Kashmir High Court. Hearing a Public Interest Litigation, a division bench of Chief Justice Gita Mittal and Justice Sanjeev Kumar granted a liberty to the Prison Authorities and the State Government to take the assistance of the experts given the fact that they have worked on the Jail Manual earlier. As soon the hearing started, additional advocate general B A Dar sought time to revisit the existing Prison Rules and take a view as to whether the changes need to be effected in the light of the directions passed by the Court. The court was also informed that exercise in this regard was under way. Dr Mehraj-ud-Din, Vice Chancellor, Central University Kashmir, and Dr. V. K. Kapoor, Formal Head of the Law Department of Jammu University, are stated to have extensively worked on the Prison Manual etc, the court was informed. "A liberty is given to the Prison Authorities and the State Government to take the assistance of these experts given the fact that they have worked on the Jail Manual earlier," the court said and posted the PIL for further consideration on 11 February next. One previous date of hearing, the court was informed that a copy of the amended Jail Manual has been received by the State Legal Service Authority, Delhi and later the court ordered that same shall be furnished to B. A. Dar, Sr. AAG as well as to Learned Amicus Curiae. "Same shall be positively examined within four weeks. Suggestions, if any, regarding the same and view taken thereof shall be filed within six weeks by the State Authorities," the court had added. |
