DC Kishtwar eats a humble pie | Court stays his orders against BMO | | Early Times Report Jammu, Feb 24: The Jammu and Kashmir High Court has stayed an order of Deputy Commissioner Kishtwar with regard to removal of Dr. Anil Sharma from the post of the Block Medical Officer Dachhan. As per the details available with ET, Justice Dhiraj Singh Thakur in a writ petition filed by the petitioner Dr. Anil Kumar Sharma Son of Brij Mohan Sharma R/O Sarkoot Kishtwar through Advocate Rahul Pant challenged the order No. DDCK/Surpr-Visit/475/FY19/17356-62 Dated 6-2-2019 in which DC Kishtwar Angrez Singh Rana while reinstating the petitioner who was suspended by him after his surprise visit in the area on 7-1-2019 vide order No. 11097-104 and ADDC Kishtwar was asked to conduct an in depth inquiry into the matter and submit the factual report. DC Kishtwar in the back drop of the inquiry report submitted by the ADDC Kishtwar reinstated the petitioner by issuing warning to him and asked him to work as Dental Surgeon in PHC Dachhan and not as BMO Dachhan and further ordered that Deputy Chief Medical Officer Kishtwar shall continue to work as BMO Dachhan in addition to his own duties which seems as the extra jurisdiction power used by the DC Kishtwar as the same power was lying with Principal Secretary Health, Government of Jammu and Kashmir. In support of the petitioner, Advocate Rahul Pant stated before the court that the impugned order dated 6-02-2019 issued by DC Kishtwar is without jurisdiction in as much as he has no authority to issue such an order. After hearing the counsel of the petitioner, Justice Dhiraj Singh Thakur subject to objection from the other side and till next date before the bench ordered that the impugned order dated 6-02-2019 to the extent it restrains the petitioner from performing his duties as BMO Dachhan shall remain stayed and allowed the petitioner to continue to discharge his duties in terms of order dated 12-08-2015. It is pertinent to mention that several controversial orders passed by DC Kishtwar were either stayed by the High Court or were revoked by the government. |
