Court takes serious note of investigation in embezzlement worth crores | | | Early Times Report Jammu, Mar 27: Railway Magistrate Jammu Yahaya Firdous while dealing with a bail application in embezzlement of crores of rupees in Co-operative Societies, took serious note of investigation done by the Crime Branch. Magistrate rejected the bail application of Surjit Singh who ran a registered Co-operative Societies meant for Rural Development Multipurpose, registered u/s 4 of J&K Self Reliant Co-operatives Act, 1999, having various branches in District Jammu, Kathua and Udhampur where people used to deposit their amount with the Managers of their respective branches but unfortunately some embezzlement was found by the applicant/accused who is the chairman of the society. The court observed that the perusal of CD would reveal that after the arrest of the accused on 26-2-2019, the IO has recorded the statements of the witnesses under section 161 Cr.P.C and most of these witnesses are the employees of the society from whose custody some documents have been seized. It is observed that despite one month time after the arrest of the accused, the statements of the complainants who deposited their amount with the society have not been recorded and even the IO has not succeeded in collecting prime evidence from these complainants which is a matter of concern. Court without discussing the merits and demerits of the case is of the view that huge amount is involved which is allegedly embezzled and this requires deep investigation. The applicant does not deserve any leniency, as the allegations are serious in nature. Therefore, there is every apprehension that in case the accused is enlarged on bail, accused may win those witnesses. With these observations, the application is rejected. |
